Abstract: Examination of health fitness to work of a jobseeker or an employee is extremely important in the field of employment relations and aims to ensure a proof for the employer that the person will be able to perform the agreed type of work and this work will not endanger his/her life or health. Therefore, it is a legitimate interest of the employer to accept in an employment relationship only such a person who is medically capable to perform the agreed work, respectively to assign the work only to employees who are medically capable to do so. The paper describes the duality of the Slovak legislation in issuing the medical opinions of health fitness to work. Its aim is to offer the professionals for discussion an interpretation leading to the fact that the Public Health Protection Act is a lex specialis in relation to the Health Care Act in process of issuing the medical opinions of health fitness to work and has a priority in application.
